Good Day:   How long does one wait for a 1041 return to be processed before taking next steps?   We are going into week 14 and we have not heard a thing. Do you have a number for the Ogden, Utah location in which to check? When we call the general number we are told that the Utah location does not have a customer service number in which to call to check on these things.   Do we file again or write a letter after a certain point?   What is the average time for the M-2's?   Any information would be beneficial to know if we are to take some action or not.   Thanks, Jill & Jack

We were recently informed by a person who called the IRS that there is a huge back up in assigning EINs.  The check cannot be cut without one. She called and got confirmation that her EIN was being assigned.  We will see if we can get the number she dialed. As for Minnesota, we are seeing some very confusing results such that we haven't figured out if Minnesota even knows what it is doing this year.  It is apparent that the Commissioner has taken very keen interest in the process and has assigned an agent, MJ Schaeffer, to pull in the reins. Some who filed M-1s got checks, others got letters, and still others got both checks AND letters. No one we know of who filed an M-2 got anything negative.  But an M-2 should generate a letter assigning a trust number. If you have not even received that yet then a phone call may not hurt.

  When trying to call in regards to the trust number I was taken down the following path:   From (651) 296- xxxx  Partnership  S Corporation Estate & Fiduciary Tax (State) which inquired about the Federal Identification Number or SSN# that it would be found under. When the SSN# was given, then a reply that it was not on file at this time and to check on the assigning of Federal ID Number I could call the following numbers 1-816-823-7777 ( this number they are available from 7:30 a.m. to 11:30 a.m. and refer to a fax number for a SS-4) the other number that was given was 1-800-829-1040 ( this number is the automated system fro 1040's or other forms not the 1041's in which you get the number 1-800-808-4262).   When called 1-800-808-4262 I spoke with #5906244 who then asked if anyone else was listed on the return and that if it was under a EIN or SSN#. When I replied the I got transferred to the Advance(d) Tax Law (Unit?) and then I was put on hold is this worth the wait? Are these the folks?   If I get any place I will let you know otherwise please let me know of any other number.   Thanks, Jill & Jack  

Good Day:   After a very long wait with the Advance Tax Law whatever, I got to speak with #9309748 and he was quite interesting in his questions asked: what type of trust it was, what assets were in the trust, how long did I have the trust, is this a living trust and do I know what that is and what type of return am I looking for . After all these questions I answered everything off of my form and said it was a Simple Trust and so on. After all of this, he finally gave me my EIN # which he said was processed on 5/7 or 5/8/01, I asked if a letter was out and he said not yet. The most interesting part of the conversation was at the end when he asked " Is your husband doing this too?" Being the fact that I am the person who has the access to my information I decided to stay with the game and reply " I am solely calling on my return." I was not sure if they were trying a privacy issue or not or if he would of given the information out but I know or do not believe that he can unless another form is filed. That is when I asked again for his number and thanked him. End of conversation.   Hope this can help someone else out. Thanks, Jill
